Hi everyone :)

I am wondering, does anyone know if having a civil protection order against you for someone else affect the DV at all? (BTW, I am female, this is a really long story how I got this, but it is not deserved at all, it just had to be done because of circumstances) Anyway, All the police and judge assured me it does not affect getting a job with police checks etc., and is not considered a criminal record at all, merely a "civil matter", (that is unless it is broken, which it hasn't been and won't be). SO basically, no charges or convictions or anything like that... could somebody please be able to tell me would it affect my chances in the DV lottery in anyway, will it even show up when they want to get police checks and the like? Maybe someone has a personal experience or some advice would be great also.. Thankyou very much for any help :)

As you say, that is a civil matter, and therefore will should not affect your DV process at all. I'm not certain that it would not show up on your police check - but even if it did it won't be a problem unless you break it, as you say.

Thank you for your help britsimon!

I was just kind of unsure if the DV requirements are more strict about things like that. I just wanted to make sure its not like a black and white thing where if there is anything at all on your record involving police etc. it would jeopardize your DV. That's great that it has the same "standards" as any other type of police check. Do any members here have personal stories of success when things like this are involved?

FYI the standard for US immigration is "Crimes involving moral turpitude" (CIMT). Yours isn't even a crime, so it wouldn't be on a "criminal record" but might appear on a police check (where arrests and other police contact can appear). The only reason I think that might be the case is so that they know about the order if they come into contact with you.

I have overheard people describing their criminal background during visa/immigration interviews. If they are worried they ask for your account of the circumstances - rather than blindly disapproving a visa.

I really don't think you need to worry about it.
