I have read so many threads here with a lot of people in the same boat as I am. this is my boat:
I'm in DMV area. My wife and I had a huge argument in mid to late 2013 where she hit me and sprayed pepper spray and I pushed her and she had bruises on her knees. I called 911 and police arrested us both on assault 2nd degree. She was released few hours after and I was kept in jail overnight. At the hearing we both plead not guilty to assault 2nd degree charges and, after invoking spousal privilege of the other person, we were found not guilty. The Document states "invoking spousal privilege". We immediately had the records expunged.
Then about an year later, she got a TPO, but it was dismissed. Then a few months later she got another TPO, but this time we went to court and she asked it to be dismissed.
Now, we are going for a divorce. So I need to fill the application marital status as separated.
SO now I'm getting ready to apply for citizenship. Since the case is dismissed, there are no arrest records, etc... I didn't know, so I don't have a certified disposition either. i got a document from the court saying nothing exists on the case. I have letter from the lawyer certifying the acquittal. When I go to the court website, you can still see the two TROs.
Since my GC expires in 9 months, my options are citizenship or renew GC. Both has a criminal check.
1. How much of this incident do I need to explain in the letter?
2. Could some members who had similar situations tell me what their experience with the process, what was asked/answered during the interview, and the out come of the case?
You know how they say when it rains, it pours! it certainly does.
