Hello Gurus/Friends
I was with company A and company A filled my GC. I used AC-21 portability rule after 6 months of 485 filing to change jobs to Company B. Now I have an offer from Company C as a W2 - Hourly Employee.

The offer letter that I received states that I would be an W2 hourly employee. I am concerned that the INS could interpret this as a Non-full time position.

Has anyone been in this situation. Please advise as soon as possible, i would really appreciate.

Thank you.

To qualify for GC, you need a fulltime, permanenet job. Hourly jobs, 1099 is not sufficient if you get RFE for EVL

If you look at a labor certification there is an area which asks for rate of pay, ie., hourly or you can say annual. Therefore, uscis would accept hourly pay for greencard purposes.
You can state you say hourly/monthly/yearly as long as your job is permanent and minimum 40 hours a week.
