Does VSC take revenge for expedite requests?

I faxed VSC asking them to expedite my case. They sent me a response saying that I am not eligible for expedite criteria.

In the fax they did say that I should be getting a Request for Additional Evidence. That is crazy coz I already recieved that once. How many times I am supposed to get RFE?? Does anyone think they are just doing to coz I dared to ask for faster approval?
 
Me too in similar situation..

My lawyer sent expedite request and twice. First time they said my FP is not current so they can't expedite. Second time when they did ( i gave FP inlocal Ins without notice), they said cases are waiting for security check clearance. Can any one tell me what it is? is it the same as FP? So I am waiting still....

sorry to hear about your RFE stuka.. but on the brighter side..

You have a very good chance of getting approved as soon as you reply to the RFE. Maybe the fax has triggered the adjudication of your case - and hence RFE!

My fax to USCIS was very detailed - I wrote to them about our 3 status inquiries for which we never got any response. I mentioned the standard '30-60 days' reply from the 1-800 number and then politely requested to expedite our cases or to estimate an approximate time for the adjudication of our cases.

Well, I did not mention in the fax about my congressional help.

I faxed this letter on 1st march and I received a reply in mail on 10th March. It said my case did not satisfy the expedite criteria. They also added that I should not fax such a request as I had sought congressional help.... So they had really 'looked into' my case...

The response worried me... and I was hopeless.. and just then I saw the approval message on 1st April.

Though they decided not to expedite the case, it was surely looked at after my fax. So keep your fingers crossed... most probably, you're one step closer to the approval!

Can you give some details about how your wrote the text and what fax number you used. I want ask about the 2nd fp notice of my spouse. Is it good Idea ?

Expediting Complications

I guess VSC is not too fond of expedite requests. They replied that they are missing my wife's fingerprints (even though the FBI and the online case status says that they were sent to VSC in early October 2003)!

I am at an absolute loss. The lawyer is mailing out a letter to VSC later this week.
 
I think getting 2 RFE's is common... so dont be surprise.. there is nothing we can do abt it.

Thanks for the encouraging response. My fax was very basic. I just mentioned that I have been waiting for a long time and they should hurry up. :mad:

Anyways, you are right about the RFE. They do seem to pass judgement soon after getting response.

I sent fax to 802 527 4816. At this point I honestly don't know if it is a good idea or not.

The text is actually quite long. It is one full typed page but the essense is that it lists out the 4 categories under which one is eligible for expedition. Then it says I did not provide any proof.
Then it says I should be recieveing RFE sson and also that when one sends a request to expedite they look only at first 6 pages and if I have any evidence beyond 6 pages they will not look at it.

To me the latter part does not make sense since I only sent one page fax to begin with.
 
RFE is a good sign.

In past few months i have learned a lot from you guys and i just wanted to share my experience with you all.

Here are my case details for myself and my spouse:
RD 12/17/01
FP1 3/14/02
Got response to status inquiry in Aug-03
FP2 10/30/03
No response to status inquiry done 3 times
Two senators involved, got response in Jan-04 allow 60 days.
Expedite request denied
NO RFE until April-04, finally after calling TIER II 20 times in past 4 months!!!!
April 2nd, RFE issued, waiting to get in mail.
AD... hopefully in two months.
(Moved 4 times with same company and notified USCIS).

Currently on 7th year H-1. H-1B expiring on July 2nd. If no GC, then ready to file 8th year extension.

Basically, to make the long story short and to answer your question, Stuka!!!!!

I think it's a good news for both of us as Vidnogre pointed out, therefore lets clear the final hurdle.

I am quite confident after spending hours at this forum and analyzing what people have to say that things are moving for dec filers.

Thank you for your details. I would like to point out that I have not recieved any RFE yet but it was mentioned in the fax.

However, you are right. I am certainly seeing some movement in Dec filers though not sure if it is more then what is normally seen. Do keep us in the loop about developments.

Did you give your finger prints in local ins office without a fp notice? how is that possible without fp notice. Could post some details like what did they ask you, what documents you show them ?, did you call them first and took appointment ?.
 
The revenge they are taking is not because of Expedite Request, its actually because, we are born in India and they just don't like Indians anymore (due to outsourcing thingie I guess)

No offence to anyone.
