does this status mean that "name check" has cleared

I have been pending on name check (or security check)
for quite some time now.
The latest inquiry from my lawyer led to the following
response..
"This case will be reviewed for current fingerprints prior
to adjudication. Please allow sufficient time for
processing".
Has anyone gotten this message in the past?
Does this mean that name check has cleared?
My details..
WAC-03-049....
485-Nov'02
FP-Feb'03
RFE-Apr'04
Email inquiries-Jun'04,Aug'04,Nov'04.

If you look into the posts of people who are (or were) waiting for name check, almost all of them had FP2 done. I have never seen status like yours. It is one of the most useless statuses CIS invented. It says: "Something will be done with your case. Allow sufficient time." Case status should indicate what has been done, not what will be done. Your status can be easily replaced with "Your case will be approved. Please allow sufficient time."

I agree with your assessment about how informative that
status msg was :)
I asked my lawyer as well, and got the reply that this
means USCIS realized that my FP has expired.. Anything
more is speculation..
Would have been interesting to know what triggered
this realization?
1. My lawyer's inquiry.. (My lawyer has been inquiring
every 2 months since we replied to the RFE).
2. Some external event happened and consequently
someone actually reviewed my case..
I am praying that it is 2. and that since I have been
pending on security check, that this was the trigger.
There doesn't seem any way to know at this point :(

But it would sure help if some guru helped me understand
the chronology of AOS checks.
The way I understand it, FP are checked first. These
checks should be fast and the results can be confirmed
by emailing the FBI.
Then name checks are done, and it involves FBI, CIA
and other agencies. Is there any way to know the status
of CIA check?
Does anyone have more info on the CIA name check?
Also is there any way to get the FP notice sooner. I have
seen some folks make INFOPASS appointments and get
the notice right away?
Any comments would be helpful..

doesn't look like many gurus are around

did you read Paul Pierre's deposition transcript?

He said that there is no system how checks are done and no reason why they are valid for certain time. If he is in good or bad mood he can decide one day that FP are valid 10 years or 10 days instead of 15 months. He sends memo to Service Centers and they will follow new rule. (This is how 15 months appeared some time ago)

First they run IBIS check (because it expires faster than others), then they run name check, then FP check. Then case is waiting for available adjudicator. When adjudicator finished his 2nd golf course, IBIS check expired. So they run name check again. Then FBI thinks: " we just did name check for this dude, something should be wrong since they are asking again. Let's do detailed review". This means they put the request on shelf for a year or so.

The checks have different validity time, so they expire one by one. While waiting for one of them, another expires. Sooner or later, at some point all checks are valid and case goes to adjudicator. If adjudicator opens case before one of checks expired, he/she approves it, otherwise sends it back for next round of checks.

For example, name check is valid for 90 days, but according to FBI (Garret's testmony) 97% of checks are done within 120 days. IBIS check was usually valid for 35 days, but there was some effort to make it valid for 90 days this year. I don't know was it successful or not.

From all pieces of information I got from CSC, there was a short period for my case in may 2004 when all checks were valid and case went to adjudicator. But adjucator was probably too busy (looking at the window or reading news) and FP expired. So they decided to run name check first, and now case is under 'detailed review'. :(

Confirmed that Iam stuck in namecheck

WAC030XXXXXXX EB2 Concurrent, ND:Dec 2002, I-140 approved,
FP2:Aug 2004,

Called CSC today: officer was helpful, 1st checked and said FP is good and recvd, then said she is going to check name check status from FBI: said it is pending.

I asked her if there was anything I could do, she said pls wait for USCIS to receive name check results.

I would have thought they would have finished a name check in the last 2 years, do name check results expire like FP's?

Attn Dima

Your theory makes sense....

Dima any estimate how long a single shot of name check takes on average?

Does anyone have any idea about what all steps are there interal to USCIS before approving an I-485 application?

beavis -

From Garret's congressional testimony, 80% of namechecks are done within 3 days, 97% within 120 days, the rest 3% may take several years.

dima, thanks for the pointers. i have only recently started monitoring the forums.. paul pierre's testimony is compelling reading.. kudos to rajiv for his efforts..
i have a few quick questions...
1. where does the 90-day validity of fbi name check come from?
2. garritty's testimony mentions the following..
"Duplicate submissions (i.e., identically spelled names with identical dates of birth submitted within the last 120 days) are not checked and the duplicate findings are returned to State. "
assuming that this procedure (which was mentioned in context of visa checks from dept of state) applies to 485, will a 2nd name check submitted within 120 days of 1st name check PROCESSING (as opposed to name check submission which in many cases happened > 1 yr back) qualify as duplicate submission...
3. finally paul pierre mentions third agency checks in his testimony. any ideas what they are?
" 9 Q. Okay. The names are run against
10 databases of some agencies. What agencies are
11 those, sir?
12 A. The one that I'm aware is the FBI name
13 check and there could be third agency checks as
14 well.
"
thanks....

I don't remember where I read about 90 days. It was probably somewhere in this forum.

I have no idea what submissions considered duplicate. I know that for some people name check result comes back in few hours after submission and for some other it takes more than year.

The agency he mentioned can be CIA, NSA, InterPol, KGB, Mosad, etc.

got an update from csc...

(my lawyer) got an (unsolicited?!) update on my case..
"this case is undergoing detailed review.. Please allow sufficient time for processing"...
in addition my lawyers tells me that CSC is advising that there is a 6 month backlog at the ASCs for FPs... And that notices are not going out unless appt is with 42 days.. blah blah...
my lawyer's previous inquiry had led to the response that my fingerprints had expired and that they would schedule me for FPs. based on my lud (9/22/04) i have been waiting ~3months for this already.. 3 more months just for FP!!
has anyone heard abt this or anything remotely similar? in this day and age i dont know why FPs would have to expire :(
regards...

Hi dimma,
Both mine and my wife's cases are under "detailed review/name check". After sending letters for inquiry to the senator's local office, we finally got a response via senator's effort about our name check status. We were told that our name checks were initiataed on 03/08/2003.... I could hardly find a word to express my feelings. It has taken nearly two years for the FBI to finish our name checks and rediculously, our name checks are still pending there. we're going to write a letter to senator again asking for further help. We have sent inquiries to FBI via emails and so far there is no response. We also sent FOIPA inquiries and the response were got in two weeks, which said they located "no records" for both of us. Based on my understanding, this should mean we are clear in FBI's records. I'm trying to cite some information you provided about Garett's testimony in congress. I'll tell the senator that our name checks in FBI has been terribly too long.... I guess if I could provide some solid information to senator, it will be more convincing for the senator to have a push to our stagnant case that are sleeping in FBI. Great thanks in advance for your help and have a happy new year.
