Hi All,

I have a friend whose I-485 was approved in May. But his son's GC is still pending. His son shoplifted, got caught and got a ticket from police. he needs go to court in several weeks. My question is, does his son's GC will be hammered because of the shoplifting? Thanks in advance for any help.

Felony

cindy7,

I believe felony charges impact the GC process. I am not sure if shoplifting constitutes a felony. I do not know exactly how it affects the GC process. Someone with experience may be able to elaborate on this further.

I don't recall who and which forum but someone else was in the same situation--a felony will affect one's application for GC. It will go on his record and when they will do background check, they will find it. I would suggest that your friend get a lawyer because it is serious.

Thank you so much to all of you, especially NIW-Nov 04. That is such a big help. I have printed it out and will pass to my friend. Thanks again.

The normal procedure for a FIRST offence in the UK is a caution from a senior officer. No need to go to court but details are held of the arrest.

If your friend has to attend court , then it is more than likely NOT a first offence in which case forget the green card as this would be seen as a repeat offender and not a one off misunderstanding incident

eg accidentally walking out the shop fogetting to pay
