Does retrogession affect South Africans?

Hi

I received I-140 approval in 01/05 and my I-485 was filed concurrently with the I-140 in 07/04. I hold an H1B and I believe that I fall into the EB3 category. I qualified for my H1B through 16yrs of IT experience.

I am South African and I would like to know if the retrogression issue that is spoken about will affect me? I so, how does this work?

Retrogression is based on country of birth, currently people who were born in India, China and Phillipines are affected by retrogression. If you are born in sourth Africa, then you are not affected by retrogression. GOOD LUCK!

Retrogression is not based on country of birth, its based on country of citizenship ie. passport.

Beg to differ. Visa chargeability is as per country of birth and not as per country of citizenship with 2 exceptions:

1. Can be charged to spouse's country of birth.
2. So called "missionay provision" where you can be charged against your parent's country of birth.
