Does NSC approve cases with expired FP?

Hello all.

I recently replied an RFE about EVL on my case, and am waiting for the
next step (hopefully approval). However, my 1st FP expired a few months
back, and I haven't received any 2nd FP notice yet.

Do they approve cases with expired FP? Does any of you have such
experience? If they never do that, then what can be done to trigger them to send me
the second FP notice?

Any help would be greatly appreciated. Thanks.

No. For approval FP needs to be current. Nothing much can be done to trigger FP2. However, you can try congressman/senetor. Give more details as RD/ND, RFE date etc,

Do not assume that you will get approval without 2nd FP notice. They always send another 2nd FP if the 1st one expired. There are many cases where 2nd FP notice was send after RFE.

In my case, my 2nd FP has also expired. I am waiting to see if they would send a 3rd FP notice.......
