Does new I-140 resets the date?

Hi Guys!

I have a Q and my lawyer like everyone else's would not give me a straight up answer.

My company was bought over recently and transition was recently completed in March 2004. My I-140/I-1485 was filed in November 2003 (SRC)

Now they say that they are getting fresh I-140 signed by the new employer and submitting for all of us.

Is this standard operating procedure? Does this reset my number in the queue? Do they have an option not to do a thing at this time and let the RFE (if any) come and then respond?

Any comments, greatly appreciated.

Thanks a lot!

Sun07,

Understand the helplessness of your lawyer - no one knows this answer. Most likely you will get one more case number for your 140.

Thank you for your reply. Does not help much however.

Anyone gone through similar experience?

Thanks,

It is called I-140 amendment. One of friend his I-140 applied May 2002 . In 2003 his company was separated from parent company in 2003 may. He got RFE in December 2003. Along with answer RFE he asked for amendment of I-140. He got new receipt number as of Feb -2004. This is at VSC.
