I am pretty sure that the "name check" process is related with 485 adjucation and has nothing to do with APs but my lawyer is trying to suggest otherwise. Let me explain the situation ....
Mine is a complicated case because after 4 months of filing, TSC transferred my 140 and 485 to a local office in Miami by mistake. After AILA inquires the case was brought back to TSC in Nov 04. Although my online status still states that my file is in Miami my lawyer has gotten verbal confirmation from her AILA rep that my case is in TSC. Another thing supporting this theory is that since Nov 04 my 140 has gotten approved from TSC and we have received our FPs from there. My wife has even received a RFE on her 485 from TSC.
Coming back to the AP situation. We applied for our 2nd EADs and APs in Jan 05 and in Feb TSC transferred our EADs to Miami again. Again via AILA inquiries we got the EADs back to TSC and they approved them in Feb 05. The APs however are still pending. Since the official processing date for APs is well beyond our filing date I have been trying to follow up with my lawyer and the TSC to see what they are doing with it. Nothing has worked so far and now my lawyer is trying to suggest that "MAYBE" our security checks are pending and hence the APs are being held from being approved. I do not think this to be true and believe that the lawyer is just making this up to get me of her case. I think the TSC has either transferred our APs to some office by mistake or have lost them.
What do you guys think?
The only reason I am pushing this issue is because my wife needs her AP to travel and her 1st AP is about to expire in a few days.
