We are in process on applying for waiver jobs in US. J1 is looking for a waiver position and currently J2 is working on a EAD. J2 employer is willing to sponsor H-1B visa but they wanted to know if J1 wont get the waiver in US and if the J1 is returning home country for 2 Year waiver does the J2 will also have to leave with the J1.
J2 employer just wanted to make sure in case J1 has to go back will the J2 has to leave with J1 legally. This question is mainly to satisfy the J2 employer's legal department as they are seeing this as a potential issue. Any help in this matter will be much appreciated.
