I am planning to change my wifes status from H4 to H1B (to work), and have few questions regarding this.
1) Once H1B is approved will her H4 be invalid?.
2) If she doesn’t work after getting H1b approval at all (assuming) , will she have any problems during her I-485 process (like will they ask for her paystubs and w2). I am the primary applicant for the GC processing and she is my dependent and havn’t applied for I-485 due to the EB3 dates retrogress.
I heard that there will be a problem if at all there is an interview for I-485, is this true?. Not sure why will they ask for my wifes paystubs and W2 if i am the primary applicant.
3) what happens if i file for H1B and H4 extension at the same time?.
4) Is it easy to change status from H1B to H4?.
NOTE: My GC processing is going on and in the I-140 stage, it may atleast take 1 year to apply for I-485. and my wife is a dependent and she plans to change her status from H4 to H1.
