My case is somewhat like this,
My LC and 140 were approved when I am in Canada, and now I am moving back to US on an H1. Currently my attorney is planning to do a AC I-140.
My question is does Chennai consulate accept AC I-140, if it does not con I go to any other consulate in India.

Can anyone come accross something like this? I am a bit worried if Chennai dosen't do a AC I-140 then should I have to wait for another yr?

Unfortunately Chennai does not accept AC I-140 apps.

As far as changing consulates, it is difficult but possible, if there is a valid excuse. This has happened in the past. If you research this forum you will come across cases such as this!

I will also try to search and if i find specific cases i will post to this thread.

Kdivekar,
thanks for your reply, NVC has assigned me Montreal US embassy ( based upon the NVC case number MTL2003XXXXXX) for my regular CP because i am still in Canada.
I don't know what my attorney is trying to do? He has done a very good job till now but if Chennai dosen't do AC I-140 then I need to ask him to stop going that route.

I am a little confused why are your doing regular CP thru Montreal and AC I-140 from Chennai?

Dont worry about Chennai rejecting AC I-140 coz that does not affect your regular CP thru Montreal. All the best with CP @ Montreal!

I have started my GC process when I was in US, then my 6yr H1 expired and my company moved me to Canada, my LC was approved when I was in Canada and we applied 140 on my Canadian address, and that's how we got regular CP from Montreal. Now that I got my new H1 I will be comming back to US and my attorney is trying to do AC I-140 so that I can go to the embassy in India for the interview.

I will let you know tommorow when I will mail my attorney as exactly what he is planning to do. I hope he dosen't mess up anything on the current CP in Montreal.

here is what my attorney tells when I told him that Chennai dosen't accept AC I-140, can anyone tell me if its true.

"Your immigrant visa will be processed at an American Consular office in India. If Chennai can not do same it will automatically be sent to another post capable of handling the case. This is done internally and beyond our control. "
