Does approved I-140 allow chaning jobs after 6-th year?

All,

I've posted this in a different thread (under LC) and then realized this group of threads might be more applicable.

Here's the scenario: I'm on my 7-th year of H1B. I've filed for regular LC in May 2002. Category EB-3. Got my 45 day letter and waiting for that case to move on. Meanwhile I started a PERM application in EB-3 and got it approved a week ago. Now, I have a choice:

1) file I-140 with the PD of the PERM application (2005). If my old regular LC application gets approved, I will have to refile I-140 to take advantage of the earlier priority date.

2) wait for the old applicaiton to get cleared and then file I-140 with the new PD.

The main question is, is there any benefit in having an approved I-140 in EB-3? I mean, would it be possible to changes jobs with an approved I-140 and being on a 7-th year of H1B.

Also, is there any disadvantage? I mean, if I file I-140 now, would iut be possible to file another one? Would USCIS reject the second I-140?

I'm sure there's many people in the same boat.

thanks,

Hi, I am in same situation except I am not in 7th year. I already had 140 approved from perm with PD of 2005. Recently filed for another 140 with BC aproval with PD of 2003. USCIS has started process and I hope I can thake advantage of new PD. I will keep you updated. I am sure they are alots of folks in the same boat. We all need to help eachother. You please let me know if you found something new.

Thank you.

Thanks! We sure should.

The only new thing I've found out is that USCIS might be very reluctunt on giving out thoise 3 year extensions. Especially for folk not from India, mainland China or philippins.
