DOL issued 2nd NOF for my case (RIR) and my company has already submitted information to DOL.
As I heard from the lawyer DOL is going to deny the case due to recent layoffs. There is a slight change to send back the case to state level.
I have got only 5 months to complete H1-B 6-year limit. 7th year extension is possible since my case is pending more than a year. The alternative would be to file a new case after accepting a senior position in a different department within the same company while keeping the old case alive.
How long does DOL allow for an appeal?
After DOL receiving the appeal how long does DOL take to response?
Am I taking a risk than looking for other alternatives?
