Hi All... My Labor cert. was approved 04/12/00 for EB2. And also I-140 filed for EB2 on 07/13/00. Although I\'m bachelors in Computer from India + 1 Yr. Post Graduate diploma in computer applications + 9-10 yr of computer field experience.
And my lawyer evaluated my credentials+experience cert. and could get education evaluation certificate as equivalent to Master\'s and filed Labor & I-140 as EB2 based on education evaluation. But on 11/07/00 VSC has issued a notice saying that, I\'m Bachelor & can\'t be filed in EB2. When i talk to my lawyer on this, he said may be i\'ve to file my labour+I-140 under EB3. Which means i\'ve to start my process all over again and eventually loosing lots of time & going back to priority date March.97 for EB3.
So at this juncture, I just want to know,
1. does anybody has faced this kind/or similar situation. And what can be done.
2. Bachelor degree in computers+1 yr. diploma in computers+9-10 yrs. of computer experience is equivalent to Master\'s for applying EB2,
If yes then how can i ask my lawyer to fight for my case.
3. Does INS VSC has all rights to disaprove my crediential evaluation certificate equivalent to Master\'s.
4. Does Crediential evaluation has no value for INS VSC.
Any help or information at this stage will be of immense value for me.
