Does any one know about this 140 and 129

Hi,
I work as Sr. Unix System Administrator,
My company filed my I140 in Feb and I got rejected in May.
The reason given by INS was that The job advertisment did not mention the requirement of Advanced Degree for this kind of job"
My company filed the petition against that with some proofs of other jobs with same responsibilities and other employees qualification.

The online status for the petition says
Current Status:

On June 28, 2004, your I290B NOTICE OF APPEAL TO THE COMMISSIONER was received here for processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

But the NSC if processing cases of dates afetr July 12th.

Does any one have any knowledge what might be happening with my kind of case. Any idea what happens most of the time.
I have not filed my I 485 till now, should I wait for some more time and should I go ahead and file that.
What happens if again get rejected, what shuold be my next action.

I am very nervous because of lack of knowledge, so any kind of information will be highly appreciated.

is your I140 MTR/Appeal case with AAU or it's still with NSC? please let me know. Then we talk more.

We filed the appeal to AAU. Now I dont know where it is, Now I have two Lin Numbers,
I already posted the web response for I 290 B
Here is the response for I 140

On June 28, 2004, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

What was the exact job ad wording and also what was in form ETA 750A under Educational and Work exp. requirements ?

I think I was EB3, and Job Requirement is as follow
Working Under Supervision of the ass’t director and system software specialist, The UNIX System administrator will be primary support person for different LINUX systems (Suse, RedHat) and also assists with the system programming support for the AIX UNIX systems on campus. Search for information on security issues for AIX and Linux. Install and test operating systems and supported softwares ( Like, MySql, GAMESS, SCHRODINGER, MATLAB, etc.). Monitoring system performance (Using tools like WBM, NMON, MRTG etc.) and assists with capacity planning hardware. Research Hardware Upgrade configurations. Help senior System administrator on Building Beowulf cluster and programming in LAN/MPI PVM etc. Providing system programming consulting to other departments owing systems sunning Linux or AIX. Assists with application installation and support for GIS, DB2, WebSphere, Jakarta Tomcat and other softwares determined by supervisor. Advise Senior Computer Specialists on issues associated with maintaining dept systems running Linux and AIX. Applications support will be mainly consulting on issues relevant to systems issues for the product (Database Interaction etc.)
 
Did u read the posting "TOUGH DAYS ahead?"
That mention that I140 adn I485 concurrent filing will not bve allowed after Jan 1st. How true is this information...
Can some one suggest me, if I should File my I485, based on the LIN number I have for I140. My employer says that I can file File I485 any time based on I140 LIN number, but I was waiting for my I140, as I was denied in June and Now I am waiting for my appeal I290 as well as I140.

Do you suggest if I should take chance for I 485...
