Does a job-change before RFE GUARANTEE an interview

I had been with the same company that filed my I-140 and I-485 until about 2 weeks before I received an RFE - believe me - it was out of necessity.

I am now curious to know if such a change warrants an interview.

Any thoughts ??

An interview is more likely now, but it doesn't mean that they will transfer your case for an interview for sure.

- In your RFE reply, did you submit a letter stating that you used AC21 to change your job?
- Did you submit an employement letter from the new firm, etc.?
- Did you move to a new city/state/service center area?

Answer: Yes, my attorney did quote AC21

- Did you submit an employement letter from the new firm, etc.?
Answer: Yes, the letter was from the new firm.

- Did you move to a new city/state/service center area?
Answer : I personally did not move, but my old employer was in New York City (I was at a branch office in Virginia) and the new one in Virginia.

Does that change anything??
 
Assuming that the new job is similar in function and pay, chances are very high that your case will NOT be transferred.

Location shouldn't matter in your case, but it would be better if your labor certification (point 7) matches with the loction you are currently working. Smart laywers will put 'various locations througout the US' on the LC form. Often lawyers put several different cities/states on the LC form (if your company has several offices). Anyhow, if the current city is listed in the labor certification than you should be fine (even if not you are probably still okay because you worked in Virginia all along).
 
I tried to make sure

The employment verification letter had extracts from the original filing as far as job description and skills are concerned, and the salary is also the same between the 2 jobs - lets hope it does not cause any extra attention.
