HI,
I recently got arrested for a DUI and my court date is on 6th june 07 but my concern is that I have applied for I-485 AOS marriage based in sep 06 and will be getting an interview pretty soon coz I was checking the processing dates and it is current for my case. So I'm scared that would they find about it and cancel my interview or even ifnthey call me will there be any problem with DUI? I have read quiet a lot of threads mentioning that they went to india to get their passport stamped for H-1 or had to mention their arrests in form DS-156 and attach all the court papers but my case is that I ahev already applied fore my green card since sep last year and its almost time for my interview and I got this DUI, so my case is not even decided yet but I'm sure I will be convicted coz my BAC was .23, but I will not have ant court papers when I get my interview to atleast tell them that I have paid all the fines and done the community service and all the punishments. What should I do????? I'm very scared and don't see any hope . If there is anybody outhere who has or had been in a similar situation please help me out. Plz Plz Plz.

Thanks Tripple citizen,
O.K. So I will have to take an oath and I'll definitely not lie about my arrest but my question is, since I just got that DUI and my court date is next month what if I get my interview before my court date? Then I will not have doccument to present to USCIS regarding the court case. I mean its one thing that you got a DUI in the past and then you paid all the fines and took all the penalties and then you can show it to them that I'm clear now but in my case I dont have anything to show them right now so basicaly what I want to ask is since all my I-485 paperwork and fingerprinting was done last year before this DUI happened, will there be any problem at this interview? And does being spouse of an US citizen matters?? And just in case if my green card interview does not come till the next month and I go to my court date first and I take whatever penalties I have to, I'll still be in the middle of my sentence doing my community service and probation, will that affect my case or does it not matter. By the way I would just mention that this is my first offence of any kind and I had a clean record till date and I'm a medical professional, still not liscenced to practice here though, but will be taking my tests pretty soon, if that could proove to the uscis that I'm not a criminal, just a mistake happened which I'll never commit again. Plz reply anyone who has the answers to my dilema, Stressed out.........

U are an idiot....

ass-face....:(

Strong drinking and driving you idiot. Who the hell do you think you are putting at risk when do such an idiotic and dangerous act? I hope the prosecutor triple your fine, suspend your driving priviledges and convict you....

Someone nearly killed me by rear-ending my car while drunk. You know how long I has to go for spinal therapy? In addition, I have to see a neurosurgeon because of pounding headaches at a cost of about a $1,000 per visit. Ever heard of Dr. Richard Restak? You can google him and learn about the type of cases he handles... You intend to be an immigrant, but what the hell is your common sense? Driving under the influence... I wish you hell in court and at your interview...denial and deportation...:) US doesn't need additional drunkards.... we already have the Irish and Brits...:p

You can take a lawyer to your interview, but I hope the immigration officer is able to find out about this DUI before the interview...so that they can teach you a lesson. The beauty of this is that: you can decide to NOT disclose it, but once USCIS finds out that you were charge of a DUI, they will revoke and deport your fat butt....:p You can't drink and drive, your judgment is severely impaired and you are a danger to other innocent and sober motorist... I know in some parts of india, people drive past donkeys and cows and all kinds of stuff, maybe drunks drive without a problem. In the US, you are going to go to jail... even though it is might be your first offense, I wish they find this to be your M.O....

To the OP drinking and driving is bad and it's no point telling you that now. The issue is it's worse since you're waiting on AOS. There's a reason why one must be extra careful and law abiding before and after receiving your GC. Not to say you go on a rampage after naturalization but I hope you know what I mean.

You need a lawyer's advice on your case.

dood

tarzan....was jane and korek with you when u did this monkeying ? :p
BAC of .23 WOW...dude, are u in california ? .08 is good enuf to get arrested, neat.
seriously, u need a lawyer, dude. I was told face to face by my citizenship IO...if you have a DUI , tell me, it is a serious offence and i can deny ur citizenship based on that. Those words still haunt me at nights and ,countlessly do I wake up, sweaty and shivering...shouting and writhing in pain, thinking the thoughts of the nightmare of that rejection. A mere thought of the rejection makes me go to the restroom twice everyday. Be safe, and keep the pedestrians and children off the hood of your car, bud.
It couldn't have been any worse timing, if you gotta drink, dang, drink at home...just walk around or ride that john deere tractor to get that DUI feeling once u are drunk in ur backyard.
Sorry to say, u are going to have a hard time, at the court, at the IO's desk.DUI is DUI....1st strike or 3rd.
Am sure what Forrest Gumppppppp wud have done here..." Runnnnnnnnnnnnnnnnnnnnnnnnnnnnnnn, Forrrrest !!!"
PS: Needless to say, I was also broadsided by a drunk driver with his SUV one night 3 yrs ago. He wrecked my merc and also almost went thru my door and almost killed me. Luckily, I walked away from it ...with $10k damage to my car and the SOB stopped and got arrested soon after. I dislike drunk drivers and their careless attitude for the lives of every1 !!! PEACE !!!
