Documents to carry for India Trip

This forum is really great. I feel like I am in touch with everybody who is in the same boat as I am.

Well I have one more question. I am planning to visit India during Oct-Nov time frame. I have filled 485 for me and my wife. I have valid H1 stamped visa and my wife has approved H4. She is going to get stamped in India. We are not sure whether we will get AP by the time I start for the trip.

I was told that I can travel on valid H1 or H4 even if 485 is stamped. So what documents I have to carry which I need to show at the time of arrival?

If you have a valid H1 visa, you really dont need to carry any documentation except for the Receipts of your 485/AP. If you use your AP then your H1 status will be lost and you will be Adjustee..
 
I am pretty much in the same situation....... Need to travel out of country in November....... But then I have a valid H1 and expect approval while I am in India.

How does one "USE" the A.P ? Do I need to present the AP when at the Departure time ?????

I was under the assumption that I need to show my AP on arrival - ONLY if my 485 has been approved.

please help - much confused

If you have a valid H1 or H4 then you need not use AP. Usually the Immigration Officer will ask for AP only if the Visa has expired or if the visa is cancelled for some reason. At various points the Airline staff check the visa validity, the AP will be used from that point onwards, till the Immigration Officer stamps the arrival on the basis of AP. Once the AP becomes the basis of arrival into US then the person's status becomes "Adjustee".

I used my valid H1 and travelled to India and back without AP, as recently as Oct 5. The immigration officer just verified where I am working and what capacity and stamped the passport. He did not ask for any documents though I carried with me my i-485 receipt in original and recent paystub etc..

Pacchai Thanks for the clarification. Just to share with you all....

I did go to the INS office to get my AP last week, however the officer on duty told me that I dont need an AP as my H1 is a valid travel document, even if my GC gets approved, I can re-enter the country without any issues.

That saved me $110. :)

Hope this info helps the others in same situation.

My 485 RD is dec 2001 .My I-94 expired in march 2002.Currenltly I am on H1B but I haven't got my passport stamped .I plan to travel to India using my Advance Parole.(valid till feb 2003).I have EAD but have not used it.

Can I face any problems while rentering USA.

Please advise
