Documents required for Concurrent filing of I140, I485?

Guys,

I got my labor certified from DOL Boston last week. I am planning to apply for I140 & I485 concurrently, I have the following questions for the experts who have already gone though this process. I appreciate your help in advance.

1. How many days does it take for DOL Boston to send the documents to my Attorny after the case is been certified (The case is certified on 7/24/03 as per the automated message).

2. What documents do I need while filing I140 & I485 concurrently?

3. What is the process of applying EAD? Do we need to apply seperately or along with I485?

4. Do we need to have any Medical done before applying I485?

(1): Usually 7 to 10 days

(2): List of docs

a) Copy of passport with copy of I-94 (both sides).
b) Copy of all I-797 Notice of Action. It is an H1B/L1 visa status document.
c) Copy of birth certificate or Affidavit of Birth
d) Copy of degree certificate(s).
e) Copy of experience letter(s).
f) I-140 supporting docs from employer
g) Copies of recent pay stubs.
h) Six Immigration Photographs (2 each for I-485, I-131 and I-765).
i) Approved Labor Certificate
k) Employment letter from the employer saying that the job is still available.
l) If applicable, the applicant must also submit copies of all marriage certificates, divorce decrees, death certificates (of former spouses), birth certificates of all children, and certified copies of any and all arrests and criminal court records.

(3): It’s up to you; you can file EAD along with your 485 or later. But if you decide not to file EAD along with 485, you need to wait till you get receipt back from BCIS for 485 to apply for EAD.

birth certificate

does anyone know whether the birth ceritificate issued by the indian embassy is acceptable in BCIS
 
No. Some where on the forum i read that who’s have submitted birth certificate from consulates/ Embassies got RFE. Submit Affidavit from your parents with non-availability certificate. Please consult your attorney.
 
Per my information, BCIS do not accept the birth certificate issued by Indian Consulate/Embassy because The Embassy/Consulate issue the BC based on the PP info and if that was sufficient then they would have considered your PP copy as proof of your birth.
