I'm a J1 with 2yr HRR in the process of getting a waiver from DOS (I have filed for it already back in July, although the No Objection letter will arrive to the DOS from the Embassy during the last week of December).

I have a company that wants to sponsor me and filed the H1B petition already (without the waiver). They just got a letter from USCIS asking for further evidence (basically a letter that asks: "where's the waiver?") and we have until Feb. 22nd 2006 to file it...

This is my question:
If the NOL gets to the DOS on, say, December 28th 2005; do you think I'll have either a waiver or a favorable recommendation in my hands by then?

My J1 expires on Dec. 31 2005...I know about the 30 day grace period, BTW...

My J1 expires on Dec. 31 2005...I know about the 30 day grace period, BTW...

It is complicated by the fact your J1 expires on Dec 31/05. Now J1 can be extended up to 5 yrs in SEVIS because of change in rule. Better you extend J1 it is permitted as long DOS does not approve your J1 wavier.

Although H1B petition is pending, whether you will be in status or not after Dec 31/05 pl check with lawyer.

30 day grace period is not used /allowed to change of status it is to pack and leave.

As such DOS will be able to give decision before Feb 22, I think current procesing time is about 40 days.

Thanks Shankara21cen for your words...now, how do I go about extendind the J1 status? with my school? with USCIS? Who?
