Check what have you done in Natiional Interest to qualify for NIW
Based on your description you have done nothing that qualifies you for a National Intrest Waiver in USA. I think unless you thoroughly review your career and find some points which you think were in national interest of USA, till then even lawyer cant dont anything to help you. Lawyer is a human being like you and me and cant do miracles. Trust me I am not trying to discourage you, but I have seen 10's of cases where every person who had been to a lawyer had cursed him/her at some point in their GC process. Some come to know about the messy job they do earlier while some dont even come to know about the mistakes they make even after charging 5K-7K for a job which you can very well do your self.
After listening to pathetic descriptions of my friends I decided to fight by myself. Filed NIW case myself. Spent 6 months to try to accumulate proper evidence that I AM IN NATIONAL INTEREST BASED ON MY PAST WORK. AND MY PRESENCE IN USA WOULD BRING BENEFIT TO SOCIETY AT LARGE.
Accumulated all evidences, left no rock unturned. Accumulated evidence from publication citations, to websites mentioning my studies, google search brings you so many things, national journals, US reports to nation, commercial citations, referee comments. Strong letters. Evidence of salary, experience, US Patent, New articles mentioning my name, Drug company infromation. etc etc.
Then went to Office Depot to find a folder that can file 6 inches stack of letter sized, double side printed evidence in favor of my application.
Arranged application in most clear way such as a book with index etc.
Even used filing label/flags to highlight supporting documents.
My friends joked with this kind of application they will give you 2 Green Cards.
Result: I-140 NIW APPROVED in 2 months.
Second, filed another I-140 EB-1 ExtraOrdinary Ability in Science.
Did same things as described above but this time SPECIFICALLY FOCUSSED ON CREATING MY IMAGE AS AND ALIEN WITH EXTRAORDINATY ABILITY IN SCIENCE. Used photocopies of same letters as used in my earlier NIW application. Thsi time I had more citaions so had to buy a data binder to bring more than 8inches thick evidence.
Result: I-140 EB-1 EOA APPROVED.
I had to file 2nd I-140 because I am from India where priority dates have retrogressed to 8th Jan 2003 for I-140 NIW so had to file EB-1 EOA where they are still current.
Waiting for 1 more week as I am trying to transfer my I-485 filed with my earlier NIW I-140 application to my I-140 EOA. Attached a copy of law saying this can be done. Seesm they dont want to do.
Wiretract my earlier I-485 next week, and then file a new I-485 based on my I-140 EB-1 EOA.
Hope will get approved very soon as they sent me letter for my NIW case that processing is done bu they are waiting for visa.
BOTTOMLINE: TRY TO FIND OUT YOU STRENGHTHS, THAT MAKE YOU SUITABLE TO BE CLASSIFIED AS AN INDIVIDUAL WHOSE PRESENCE WOULD BE IN BENEFIT OF US SOCIETY. MOULD YOUR CASE FOLLOWING ONLY THIS THEME, NOTHING ELSE. EVERYTHIGN ELSE WHOULD HELP PROVE THIS POINT TO overworked INS Officers. PAPERS, CITATIONS, CONFERENCES, AWARDS SHOULD ALL BE USED BUT IN SUCH A WAY THAT THEY ALL PROINT TOWARDS YOURS BEING IN NATIONAL INTERST (IF YOU WANT TO APPLY I THIS CATEGORY).
