Hi,

My current status is H-1B (I-797A) and I recently got a new job. I have started my H1-B transfer with the new company with the photocopy of my I797 & all other documents with premium processing. So I should get my i797 with the new employer soon. My previous employer has not given me my original I797 (tired asking him multiple times but seems like he is not willing to). And I am planning a visit to my home country end of November. So for visa stamping, will I need original i797 of my previous employer as well or just the current employer's i797 is fine?

Would really appreciate if anyone can help me on this.

Thanks!

To obtain your visa stamp, you will need an original I797 from your current employer. It confirms your H-1B status with the new company. An original I797 from a previous employer, while helpful, is not required for this procedure. You must have the original I797 from your new employer with you when you complete your H-1B visa interview.
