Do we really need an attorney to respond RFE like Emp. letter..etc

Hi Guys,
Please post your suggestions about having an attorney for responding RFE like Emp. letter, pay stubs, W2, tax returns..etc….Can we able to manage ourselves to respond these queries…

If you have not changed from your sponsoring company (i mean you did not use AC21), then its a fairly simple task and you don't need an attorney to reply to the RFE. You just send all the documents that they have asked. Include a cover letter saying "With reference to your Request for Evidence for my I485 application with Receipt Number EAC******, i am herewith submitting the required documents. " (Add Thanks and your signature :p) . That's all.
But if you have used AC21 then there are 2 scenarios. Either you have the Labor Certification details (OR) you don't have them. If you don't have the LC details, then you realy do not know what your employer has mentioned about your job title and description. Then you need to be very careful and you need to engage a lawyer. If you used AC21 and if you know the details of LC filed by your sponsoring employer, then you can send the RFE response yourself (if you don't have money to engage a lawyer). You just need a Employment letter from your current employer and that should mention the same job description as your LC did.

Every RFE notice will contain a bar code which will identify your application (EAC number). You don't have to submit cover letter also as long as your submitting every thing what they are asking.

I have been asked submit only employment letter. I sent original RFE notice along with employment letter with in a week on line message changed to RFE Recieved.

If you changed companies then you need a lawyer to represent you well like dsatish told. Need a nice cover letter etc

But if the original RFE is sent by VSC to Lawyer, isn't VSC expecting to receive the package back from such Lawyer?

By the way, there is no courtesy copy RFE sent to applicant, correct?

I noticed from Rupnet that approx. 25% cases get RFE. Is this an accurate estimate? Will it increase or decrease over time, considering the huge backlog faced by VSC?

I believe they don't care. In my case package went from me not from lawyer. On line message got updated, I didn't hear any problems.

I am not forcing you, it is up to you decide. If you think attorney response will give you peaceful mind, go ahead and do it.

The reason I asked is a friend changed employer and his Lawyer is with original sponsoring company. That Lawyer would receive the RFE but friend is wondering if response can be sent directly by him to VSC.

It seems there is no requirement to include a "cover letter" from Lawyer, as long as documents requested in RFE are sent.

Absolutely no need for attorney in replying to RFE........

I had sent the reply to my employment related RFE myself and got approved. Covering letter is a waste. I had not included that at all.

Just make sure that the original RFE paper in BLUE is on top (very imp.) and staple all documents together and send it through UPS or Fed-Ex.

RFE will be sent to attorney not to applicant. Your friend will not recieve it. He needs to talk to old attorney to get this rfe notice.

OK, Lawyer said she'd send anything received from VSC to applicant. I think there won't be a problem.
 
Guys,

My lawyer is asking $600.00 to respond for the employment letter RFE. This is an AC-21 case. I paid $250 to prepare AC-21 letter to inform INS about job change.
