do we need tax returns if we have a sponsor?

i'm applying for green card as a wife of US citizen, my husband doesnt have tax returns, but his father's income is enough to support both of us, can we do without my husbands' tax returns, if his father signs i864?

did he file taxes? if so, he needs the returns or IRS transcripts.

Your husband is still the sponsor, even if he makes $0. Your father-in-law is the co-sponsor and both must fill out an Affidavit of support.
 
If your husband is required to file per tax code, he needs to file before he can submit I-864. If your husband didn't need to file, attach a sheet citing the specific reason and IRS publication that your husband didn't need to file. Usually, a reason would be that your husband's income is below a certain threshold and possibly that he is claimed as a dependent on someone else's return.
