Do we need Lawyers for CP?

It looks like to me that all CP needs is couple of forms(DS230 / I134) and bunch of documents(BC, MC, Emp Letter, Medical, Bank stmts, etc.). Even if you are refused visa at the consulate, these lawyers dont seem to be of much help, according to some of the users (from other threads). Then, why should you pay $1000 - $1500 to lawyers for the CP process? Dont you think it is money down the drain?
Ofcourse, for LC, I140 & I485, it could be justified.
People who have done wihtout lawyers for CP, please stand up!
Thanks

Lawyers don't add much value while doing CP

cannon576,

I agree with you. Lawyers don't add much value in the last stage of GC, especially while going the CP route. Forum like this provide a great deal of valuable first-hand information.

Usually an individual would engage the services of a lawyer for the complete process of GC. (First Stage: Labor certification; Second stage: Filing I-140; Third Stage: AOS or CP). If you have itemised the payment for the services provided by lawyer and paying out of your pocket, then there not much value while doing CP (third stage only).

If your company is paying for the services provided by a law firm, then there is not much loss. I would suggest to keep the law firm services. Any way that just my opinion.

Thanks.

when we apply for CP and send they send us packet 3 and we fill it up, dont we have to send them a copy of I-140, which we usually dont have. How do we get this.

The whole process of CP is based on the fact that your I-140 has been approved. The NVC would receive that information from the INS. I-140 is not part of any documents that you have to send.

However candidates may carry it to the Consulate just to feel more confident. You or your attorney would have got the I-140 Notice of approval.

I have decided not to spend another $1500 for lawyer for CP. But my I140 currently have lawyer's address and i presume that they will send the visa fee bill to the lawyer. Will it be possible for me to call up NVC and tell them to send it to me instead, or will it involve bunch of paper work and delay the process?

Same issue here. I am thinking of applying myself. There should be a form for address change.

In my case I have to move the I-824 to ask INS to send it to NVC.

Any documents to be sent with it?

If your consulate is mumbai, then you can use your attorney to file I824 and then send AC-140 (Attorney Certified) to the consulate directly to speed up the process. I guess, in that case, it is better to use a lawyer. If Chennai is your consulate, then AC-140 is not a preferred method. I dont know the details of I-824, so ask users who have done that. You might be able to find it if you search this forum. Remember though, it may take more than a year if you take the I-824 route if you dont use AC-140.
Good Luck

Cannon,

My consulate is Montreal.

Also, did you find a way to change the address on I-140 to your personal address?

Do we have to do both?

I mean Can an AC140 be done without I-824, or it that required?

AC 140 with I 824

AC 140 (AC: Attorney Certified) needs atleast receipt of filing of I-824 (Application for Action on an Approved Application or Petition) for some consulates and approval letters of I-824 for others.

The list of consulates accepting AC 140 is listed on the URL below:
immihelp.com (Then click on Consular Processing, and then on AC 140)

I-824 is filed when an individual wishes to change from Adjustment of Status (AOS;I-485) to CP(Consular Processing).

Thanks.

Here is my 2 cents... All you need to call NVC and say that you want to remove your attoreny from your case. They would send you a letter called "ACL" (Agent of Choice Letter) There you could say where (or who) you want to receive your mail. It could be anybody.

Hope this helps.

does it have to be an person/address in USA or it can be outside?

It could be any address. (with a "care of" too!!)

The address could be both within USA and also outside US. But the NVC recommends the address to be best within USA as there is minimal chances for loss of mail!!

Hope this helps.

I fired my lawyers immediately after I-140. The lawyers did get my package which I had them mail it out to me. However I filled and dispatched all the communications.

Got done with my CP on Dec 23rd. No sweat.

Feel free to ask any questions.

thanks,
Bapa

Bapa,

I am sure we will be askign you many questions.

Here are a few:

1) Which counsulate did you aplly to?

2) If it is AC140, then a lawyer is a must, isnt it? Looks like you didnt to AC140. How long did it take for you?

AC140 Lawyer is mandated. It took me 5months from the time of my I-140 approval.
