do we have to enter the US at the same time ?

hi,
I m the winner and my husband is the beneficiary. we will have CP in Paris. he is student in the US and will come for the interview. Can he go back by himself and me after or do we have to get in at the same time. does anyone know? thanks
 
Hi FifiParis,

As you are the principal applicant, you have to be the 1st one to enter: you can enter both at the same time, but he cannot arrive alone ( without you having already entered the States).

By the way, I was a 2005DV winner ( EU18xxx) from France, so you may want to benefit from my own experience.
_Student in the US (F1visa, MS degree)
_Received NL July 22nd 2004
_Saw a lawyer
_Got married so that "Significant other" would also get it. ( both of us were students in the US)
_sent back the forms late October ( after the wedding)
_our number became current in April
_ called KCC, no interview in April nor May: case not finished processing yet ( I do not know why it took them that long)
_ went back to France in May just after graduation for medicals
_ Interview June 1st
_ Received visas June 3rd.
_ Entered the US June 15th in Boston
_ Case processed at Texas Service Center: received green cards 3 weeks after POE.

Our interview was very smooth: we had all the documents, plus extras: proofs that we had been together for a long time, tax returns for both of us, we both had job offers.
No question related to immigration intent: as an F1, you're not supposed to. No question about that.

Nothing, we just had to wait for our names to be called. So do not worry too much, I know you will, but you should be okay if you meet all the requirements.

I was wondering did the French consulat asked you to bring special documents.
I have received the second package. the list of doc needed is included. but it seems that the consulat can ask us more doc. did it happen to you . also did you have an affidavit? what documents do I have to joint, those specified on the affidavit , i guess .

The consulate itself did not ask for other documents. We just had been preparing the interview for so long ( having a lawyer, reading many discussion boards...), that we knew " the more, the better".

Just take anything YOU think is relevant to your case:

I won as single, and got married. So we wanted to prove that it was a true relationship. We brought pictures with dates behind them, of family events, of travels we had done. We also had previous lease agreements.

The officer may or may not ask for US tax returns : you mentioned your husband is a student in the US. So, at least, he filed form 8843, and maybe also 1040NREZ if he had a US source of income ( is he a TA, a RA, fellowship award, any kind of US money?). In our case, the officer did not ask for it.
But if you have them, just bring them. Just to be safe, and not to regret.
You can ask for a tax transcript, it's free. (not a copy of your return, then it's $40).

We did not have an affidavit of support. We had more money than it was required, and both of us had job offers: we had graduated in May from a Master's degree, so it was pretty easy for us to get a job ( and we were already living in the US).
But I guess it's worth mentionning that we first showed the bank statement. But the officer specifically asked for more: that's when we showed our job offers.
In fact, the officer also evaluates your potential to find a job (not to become public charge): if you do not meet the requirements of the poverty guidelines, it can still be okay if you've got potential to find a job.

I guess if you have ALL the documents, you'll be fine ( if you meet ALL the requirements). The rules say that YOU are required to have at least a high school diploma ("bac"), but the truth is that it's better if both of you have one.


We were students in Massachusetts. ( so we chose Boston as our POE). Now we both work in Connecticut.

By the way, one of your previous posts : there are only a few french dv winners, because not too many french people initially play.

I did not have an affidavit of support , so I don't know.
As evidence of support, we showed the originals of bank statements and job offers.

For all the required documents ( birth, marriage, police, degree...) we had made photocopies, which they took for their records.

can you please tell me in what consisted the medical appointment.
do they ask you if you are diabetic or to tell if you have any disease. my husband is diabetic and has now an eye infection and we are worried to tell the doctor. the appointment is next week.
can diabetes be a reason of rejection.
note that my husband is on opt in the US and has health insurance with his job. cp interview in paris next week. thanks
 
We chose to see the doctor A.V. Mayers because it was the most convenient for us with public transportation.
The fee for the exam is 150 E (euros) and it includes the blood test and Xrays. With this doc, you need to go to other buildings for Xrays and blood test, but you can walk to these places from the doc's office. We called the doctor a couple of days later to make sure we could pick up the envelopes.

We were asked questions about our health in general, as any medical practitioner would do. So I would say, you have to mention your husband 's condition.
However, I do not think this would be an issue, HIV and tuberculosis are.
