Do we HAVE TO change I-9 after EAD

"RECEIVED" doesn\'t equal to "USED".

We have been shouting here 1000 times that you lose H1 status only when you start to USE your EAD to work.
 
I-9 is used only when you "use" the EAD

Jony,

If you want to join a new company using your EAD instead of H1-B, then submit an I-9.

Or, if your H1-B is reaching the 6 year limit, then file I-9.

Else, my suggestion is not to complicate things by filing I-9
 
My experience is: educate yourself and don\'t rely on and exploit others too much

A lot of tragedy comes from the ignorance of immigration petitioners. For instance it\'s too late for this guy to get to know that you-use-your-ead-you-lose-your-h1. He should have known that early so that he and his family can make right plan accordingly. It always surprises me that some wonderful engineers won\'t spend 5-10 hours to get themselves some basic immigration knowledge. Don\'t think only lawyers can be knowledgeable. No! Most of lawyers know little more than me :-) Don\'t rely on lawyers. You know what I mean. Most of them are just nuts. And don\'t rely too much on us since we don\'t know in detail your case although we will more than happily help you.

why should it matter if you lose H1-B if you have plans to stay with the company???????????
 and also in case of lay off , you can always find another job in similar category on EAD after 180 > days,
 get new letter from new employer..anyway , I am quite sure that I will not be laid off soon given the current project
 length before 485 approval
 
Well, things are not that simple ...

H1: still non-immigrant status although dual-intent is allowed.
EAD: related to AOS.

It\'s easy to "slip" from H1 to EAD, when it\'s hard to get back your non-immigrant status. In case (while it unlikely happens) an EAD USER\'s GC case got rejected, he will be in dilemma. So keeping H1 is very important.

The other thing that concerns H1/EAD is the status of your spouse. My wife was on H4 and after she started to work on EAD she lost H4 status and is only on AOS. This also involves some legal issues. If the primary petitioner (like me) uses EAD, his/her spouse who holds a dependent status will also lose the H status. For instance if you use EAD your wife\'s H4 goes out but if she is on F1 she will not be affected. A lot of tricks.
