Folks,
  Do you have to apply for an EAD. Can I just work with my H1 and get 485 approved.
Is there a drawback to not filing EAD.

Safer to apply for an EAD these days.

Although it\'s not a necessity to apply for EAD at all in your 485 stage, but it\'s a good idea to apply for it due to the unpredictable behavior of sponsoring H1 companies during bench period.

In addition if someone is married it gives the spouse an option to work legally.

Also there will be some time delay between when you apply for ead & when you get it so it\'s best to apply for EAD while filing for 485.

It is perfectly permissible for the spouse to apply for an EAD, irrespective of what the H1 holder does.
