Do mywife need to be in Status for CP? !!!!!!

My Status

Finally Got my Labor in May 2003

But Now...

I) my wife was in H4 and it is valid up to Dec 2003
ii) She got a H1 in Nov 2002 but didn't start or join the comp and she didn't get stamping in her passport too.

Attorney says that my wife is now not in status since it is been more then 60 days she got the H1.


i) Is my wife in Status now?
ii) If not how can i bring her to status?
iii) Is there any risk in filling 140/CP at this situation or can i go for 140-485?
vi) Now what are all my options?

I would really appreciate if you can give all your advices and share your experience
