I am a GC holder and have been spending more than 9 months a year outside US - with multiple trips back and forth. All my income is also foreign but I file US returns, have bank and other accounts but no property in the US. My wife had a GC but hasn't been to the U.S. in few years. My one son is US citizen and other is not. For work reasons, I will need to start spending more time in the U.S. but I want to keep it to the minimum as family will not be with me. I want to continue to spend more time with family outside US until they can come to the US.
Q. Will I qualify to apply for GC (I-130) for my wife and son born outside US?
