Hello, how can i know if i qualify for Cspa? My uncle filed a petition for my mother and the priority date was November 19 2007, I was born on Jan. 24 2001, and we received the Notice of Immigrant Visa Case Creation on July 18th, 2022. My uncle does not remember the approval date but the visa bulletin final action date is January 1st, 2008. I have been included for both the Immigrant Visa Case Creation and the Interview appointment. We have our interview scheduled for June 23rd but I just received an email from the embassy telling me to verify i qualify for Cspa before I go and I find different calculations on whether I'm good or not.

It’s impossible to calculate CSPA without the approval date. Can your uncle not find the notice anywhere?

By the way, your priority date became current in May this year. it seems a lot of cases were being approved within 1-2 years at the stage that your uncle filed the petition, and if that’s the case you aged out. Your approval date needs to have been on or after 27 February 2011 for you to qualify under CSPA.

He just found this, I assume june 28th 2010 is the approval date? Am I supposed to calculate from my current age or the age that a visa became available to me, that's almost a 3 year difference. Also what does it mean that my priority date became current? Sorry I find this a bit confusing

yes, that’s the approval date.

your priority date became current the first time a visa bulletin was published with a date after your priority date, which was the May 2025 visa bulletin, so the date your priority date became current is 1 May 2025. The way it works is that the time between when your petition was filed (Nov 2007] and when it was approved (June 2010] is subtracted from your age on the date that your priority date became current to calculate your CSPA age. So the time between petition and approval was 2 years 7 months (give or take a few days, its not close enough in your case to worry about exact days) and that gets subtracted from your age as at 1 May 2025, which was 24 years 3 months. That gives you a CSPA age of almost 21 years 8 months and unfortunately you need to be under 21 on a CSPA basis to qualify.
