Do i need to use AC21????

Hello All,

I have a question if i need to apply for AC21 in this case??

I had 3 layers on top me at present and I wanted to move to Direct vendor for the same job. My current employer didn't have any problem if i skip him in this loop.

I got I140 approved and I485 is pending for more than 4 months thru my current employer.

After I finish the 180 days bar do i need to apply for AC21 to change employers even if it is a same job?

Can some one please clarify this with me and also let me know the possibilities that i have in this process??

Yes you should AC21 because your employer will change. Job duties will be similar that is good for filling AC21. But make sure you salary should be around present salary.

To file AC21 Job duties should same or similar and salary should not change much.
 
Your employer is the one who pay your salary. The clients pay your employer. You're not clients' employee. It doesn't matter with the nature of job and location. You have to invoke AC21 since that's changing employer.
 
Salary variation does not matter

I used AC21 and I was getting 22% less than mentioned in LC. My location also changed. As long as you can get a similar job duties you should be good.
 
If I want to move oinother location of same employer after 140 approved and 485 pending more than 180, do have apply ac21?

does the company get rfe why would moved the employer to another location.\

but there would be hike in the salary as i'm taking out 2 layers in between for the same job and duties..So this is going to be a problem to use AC21. correct me if i'm wrong..
