Do I need to transfer my 486 case from VSC to NSC? Please give some ideas.

I will move from New England to NSC region. I was told if I change address my cases (486/765/131) probably will be transfered to NSC. I checked USCIS web site. For 486 processing, VSC is June 2003, while NSC is in 2002.

Do you guys think it is good NOT to change address, so my cases may be processed earlier?

Is there any other concerns I need to consider of?

My 765/131 are pending for two months in VSC. I can't work or travel. I'm now thinking of change address for only those two cases, hoping to push them be approved soon. Is it reasonable?

Well your case may be transferred to your local INS service center

Which one, my 486 or 765/131 case, do you mean is transfered to local office? They sent RFE for 765/131 and I replied in January. The web was updated three times consecutively. So, I think they are still in VSC.

Do you think it is good to transfer? From the web info, NSC is slow, but someone said NSC is efficent. I am confused. Also, after transferring, will my case processing queue be reset to wait from the begining? (I sent 486/765/131 package two month ago.)

Your 485 case will be transferred automatically after you change your address...ie. file ar11 and call up USCIS regading change of address

Transfer is not related to change of address or filing AR-11. Transfer can happen for any cases at the best it is random.

There are many cases on this forum (including mine) in which address was changed and never got transferred.

Talking about service center transfers it is very rare phenomena.

I know more then 30 cases where people moved to the different service center areas different cities etc. All of us got Laid off from NY and moved to different places. All of us filed AC-21 and changed the addresses.
There were some cases where I-140 was revoked. Not even one case was transferred. Every one got approval without any issues except couple of RFEs.
 
Oxa1, My case is similar to yours. I moved to an NSC area 8 months ago. I filed AR11. They have not transfered my file so far. .....Never know what will they do tomorrow... you must know these guys are so unpredictable.

I do not believe in the processing dates they publish. Neither of these centers follow FIFO. So if it is NSC or VSC really does not matter. What matters is your luck.

Even though I filled AR11 in a timely manner they had sent my FP2 to NH. We had to call and change it to a local office.

Other complication is all your future EADs and AP will have to be filed at NSC now. Again the results are unpredictable. NSC approved our APs but not EADs. The EADs were transfered to VSC and the total time was about 6 months to receive the approval and card.

You should always file your EAD and AP applications/extensions to the service center where your I-485 was filed, unless otherwise notifed that your I-485 was transferred to a different service center, or your local office. If you never get notification that your I-485 is transferred, then you should continue to file your EAD and AP extensions where your I-485 was originally sent to.

This is why your EAD go transferred back to VSC for processing. Your I-485 is not in NSC, and thus NSC did not know what to do with it.

Could you please tell me from where you got this information. I sent my AP to VSC last sep 2004 and EAD on 01/31/2005.

I got reply on my AP from VSC saying that they are waiting to get some information from another Office :confused: and I don't know what they are talking about.

BTW I moved last year from east to west cost and my address has been updated with USCIS.

I had the same understanding as you guys and I never wanted to go through NSC. But my smart lawyer was positive that I must to go through NSC as I reside in the NSC area.

Can you help me convince my lawyer. Do you know any reference to law or rule or directive from USCIS on this.

I-485 can be also filed where your employer is located since that will be your permanent place working after obtaining GC.

Question 16 on the form:
Go to Part 2 of the Instructions, Eligibility Categories. In the space below, place the letter and number of the category you selected from the instructions (For example, (a)(8), (c)(17)(iii), etc.). Eligibility under 8 CFR 274a.12
