Do I need to file I539 for H4 extension

Hi,
I am currently on H4 visa and is valid upto July 12,2006.Also my I94 is valid upto July 12,2006.My spouse recently applied for H1 B extension and is waiting for approval. We are planning to visit India on July 27,2006 and get our passports stamped based on his new H1b approval. My question is do i need to file H4 extension.If not what would be my status on the date my I-94 expires-July 12, 2006.Please advise

Hi,
Yes, you should apply for H4 extension. You can ask your husband's lawyer regarding I539 filing. It's better to apply ASAP. Sometimes it may take long time to get approval. Wish you all the best.

Yes you should file H-4 extension otherwise you are out of status even if your husband's H1 is approved. Normally you should be doing both the filing together.
