Hello Everybody,
The company I work for has been bought out by another same kind of company.
My job title, job description, address are same. But the name of the company will be changed to the new.
Do I need to file AC21 ?
Please advise.

My case was

My company changed hands and names many times with me doing the same thing at the same desk for the same money. I did not file a thing since I was told the new company is successor of interest for immigration purposes.

My case has been approved without RFE but I know people who got EVL RFE, told the story and got approved.

maybe an I-140 amendment, citing new co. as inheriting the interests of the former.
Filing AC-21 is simpler then amending I-140 at this stage. Do not show Successor in interest which requires amended I-140

However, legally it is required for the new company sends a notification to USCIS that they are the "successor of interest", if they employ any non-immigrant aliens. While this is the case for every company, depending on the attorney, some always suggest to file for I-140 amendment while others say not required if your I485 has been pending for more than 180 days, when the transaction(acquisition) happened.

Speak with an attorney.
