Do I need to file -140 within 45days after LC?

My lawyer said we have till end of this month to file I-140. My LC was certified in mid-September. I do not see the rule anywhere.

(I am applying for GC through work - EB3. I live in Texas.)
 
As far as I know, though they have plans to enforce this 45-day limit, it is not yet implemented.
