My friend has a valid H1B (till 10/2005) from his earlier company (say A) but recently he has joined a new company (say B) and has recd an H1B approval through this new company. The new company's H1B approval I-94 stub says that he can stay in this country till 7/2006. His primary issue with not wanting to get his new H1B stamped in India when he is visiting there during Oct '04 is because of his irregular pay stubs and his fear of rejection due to this issue. He doesn't have continuous pay stubs through out his stay here in the US (he was laid off and didn't have a job for abt 2-3 months so no pay stubs). Can he come back into the US with his old H1B visa stamping (ie. the one which has company A's name on it)? Please let me know your valuble thoughts so that I can pass it on to him.
