Hi-
I am from India and hold a H1B, issued in Oct 2004 and valid till July 2007, that I havent used till date. Also, I have never been to the US before.
I need to be in the US in a few weeks from now for a internal seminar organized by my company. This seminar is for 4 days. I plan to return back to India after the seminar.
I have been told to get a B1 for this visit (even though I hold an H1) for the following reasons: I do not have a Social Security Number and cannot get one during my 4-day stay in the US. Therefore, my employer cannot pay me a salary for the 4-day period in the US and will be required to compensate me by paying me per-diems. Hence I need to enter the US using a B1 (and not a H1)
My question to you - can you please provide me an independent point of view on whether I actually need another visa (the B1, that is) when I am actually holding a valid H1? If yes, am I likely to face any problems (a) at the consulate (b) at my port of entry?
Please advise.
