Hi Guru's,

I am in a very critical situation. I would like to get your valuable advices. Please help me !!!!.

I would like to explain my current situation.

After my Labor approval my lawyer told me to go for concurrent processing. I told my lawyer that my wife can’t come here and I would like to proceed for CP for her and I would like to apply for I140 and I485. My lawyer applied for I140 and after completion of my medicals she applied for my I485. Now the problem is my Employer layoff my services and I have to work on my EAD. One of my friends told me that if I use my EAD then my H1 would not be valid. And I can’t apply for H4 on that H1 because I am getting new pay slip. So now I am in a dilemma. I would like to bring my wife after 10 months. So right now I have only 10 months in my hand to do some thing to bring her over here. I need your help.

Can I start her CP before my I485 approval?

I know that they can’t approve until I get my approval but I can save some time
by applying before my I-485 approval.

What is the process for starting her CP?

One of my friends told me that to apply CP for my wife lawyer should apply for Form 810 with I140. But I don’t think my lawyer applied for Form 810.

I was in the impression that CP is going to take only 3 to 4 months. But my friend told me that before I start CP I need to get approval from NVC and it is taking more than a year now a days.

I am getting mad with all these issues ringing in my head and I can’t think of any alternate ways.

Could some of the experienced guy’s advice me and direct me in to the proper direction?

No, banging your head won't help...

Kidding aside, I think you would have been better off with CP from the beginning. Both of you could have obtained your GCs at the same time. The only caveat is your layoff-if that happened before your interview at the consulate, your case would have folded. You are not getting many responses in this forum because yours is an unusual case, you have to consult your attorney. Pose this question in Ron Gotcher's forum and he may respond with alternatives.
