Do I have a strong EB1-EA case?

Dear forum members,

I would like to consult you and take your advice regarding my case. I have a pending EB2-NIW as mentioned in my signature below.

My EB2-NIW case may yet take 4 or 5 months more as it appears from the most recent processing dates published by USCIS for NSC. My question is as follows. Based on your experience, how good are my chances for a successful EB1-EA case. My credentials are as follow:

1- Publications: I am the author/co-author of 9 strong Journal publications, first author in 4 of them, 15 refreed conference publications and attended most of these conferences in person. I do also have two book chapters at different books being the first author in one book chapter, and the second in the other. I am also the first author of a one book published recently by Springer Verlag. I have 4 other publications in review.

2- Judge of others work: I am a reviewer for at least 20 of my field's Journals, and have done tens of reviews already. I have also participated in two grant review Panels at the NSF in Washington DC.

3- Awards: Nothing exceptional. I would say however that I appear in Marquis Who's Who in America.

4- I have 11 recommendation letters collected for my pending NIW case. One of these letters is from a director at the Army Research Laboratory, and a second one from an NSF program director.

5- I have worked on various government funded programs and grants in the past 6 years.

Finally, I have a Ph.D. and have just completed one year of post doctoral work.

I appreciate any help or suggestion by forum members. I am now seriously considering to file for EB1-EA case. I hope also to use the same letters I used for my pending EB2-NIW case!

I have highlighted (in RED) the points which I believe will leverage you to an approval for EB-1EA. I also had same case as you. First applied for EB-2 NIW, got approved but visa retrogresison gave a large setback to my priority dates. So later applied for I-140 EB-1A and also got approved. Now last week have filed another I-485 based on my EB-1A after my several attempts to link my newly approved I-140 EB-1A to my earlier filed I-485 failed.

5- I have worked on various government funded programs and grants in the past 6 years. Does not make sense everyone works in some or the other time i their career.

Finally, I have a Ph.D. and have just completed one year of post doctoral work. (Thats neagtive point infact, since it displays that you are a novice, so better dont emphasise on years of work experience rather start counting from your Masters and then highlight your technical skills that you are the only one this and that blah blah...)

Look for other things in your career which might help you. From what you mentioned I believe the points in red are of use.

I have used an attorney for my EB2-NIW case. I plan to apply through the same attorney for my EB1-EA case. Did you use an attorney yourself? My attorney did not give me a copy of the cover letter he prepared for my EB2-NIW case.

It is also exciting to hear photocopies of letters you had for EB2-NIW were good enough for EB1-EA. I plan on doing the same and using the same letters I used for my EB2-NIW letters for the EB1-EA case. I have two original copies for each recommendation letter I requested.

NO, AFter I saw so many of my friends getting screwed up by attorneys, I decided to do on my own. My attorney did not give me a copy of the cover letter he prepared for my EB2-NIW case. To tell you I never submitted a cover letter in any of my petitions.

It is also exciting to hear photocopies of letters you had for EB2-NIW were good enough for EB1-EA. I plan on doing the same and using the same letters I used for my EB2-NIW letters for the EB1-EA case. I have two original copies for each recommendation letter I requested.Worked for me does not mean will also work for you, so do your own due diligence
