Hi all
I'm a foreign and living in US for six years, although i have ten years old visa; my I-94 form is expired six years ago. I were selected for further processing for the 2008 dv lottery. I heard from somebody that I may not claim in this status but i want to try for all that. If anyone have a experience or in an evidence please inform me about your information. If I may try applying what procedure should I follow, Thanks a lot...

1) what do mean you have a 10 years visa, now are you legal or not?

2) were you required to register ( 2003 registeration for people from certain countries) was your original country one of those who are required to register, and did you register?

3) If you are illegal right now, it will be very diffcult for you to get it, since you will not be able to adjust status here ( in violation ), so the only solution
for you is to go back to your country, and get your interview there, the only
problem,with this solution is as soon as you leave this country, you will fall in the 10 years bar system, because you was here illegal more than 180 days, from
time you entered,
In your case you can ask for a waiver to remove the 10 year bar, but by the time, you get the wavier it will be too late for you to get one of those, 50,000
green cards. bearing in mind you will never get a lottery green card after some time on SEPT 2008, SO YOU REALLY HAVE NO TIME.
YOU MIGHT NEED TO CONSULT WITH A LAWYER ALSO, AND TRY THE HARDSHIP AVENUE.

Salam, brother I am from Sudan, but I live in the US, for the past 18 years,
immigration is one of the fields I know very well, besides other 12 fields, mostly learend every thing here in the US.
the reason why I am here in this form, because I am in the process, of launching a very unique services that makes it very easy for new comers, to easily make it, without wasting those first 3-5 years just trying to know the system.
when the service is ready you will see it here in this site.

if you are out of status for the past 6 years, you are subject to 10 year bar from entering US (if more than 364 days passed from I-94 expiry, you are barred for 10 years). talk to a lawyer to find out if you qualify for a waiver (i doubt that) :(
