Do I Declare EAD (I-9 Form) if i use my AP..have a Valid H1 Until sep 2003

Grurus do i have to declare EAD if i use my AP during my travel out of this country. I still have a Valid H1 until sep 2003 but not stamped. Please Suggest.

Yes..

If you don't have a visa stamp (even if the visa status is valid until 2003) and if you are using AP for re-entry, that means you cease to be on H-1B once you enter the US and must use EAD for employment.
