Do EB2 & EB3 categories affect EAD processing

Hello Gurus,

Could you please answer following questions for me?

1) Do EB2 or EB3 categories affect EAD renewal speed? My I485 is pending and this is my third EAD renewal.
2) Does financial Position of your company affects the EAD renewal?

Depends ... give us more information ....

Which Service Center are we talking about here ?
Your 485 pending since when ? (RD or ND )
EAD renewal pending since when ? (RD or ND )

What's the status of your 140 ?
What financial trouble are we talking about here ? What is the company size ?

The answer to your questions is 'no' and 'no'. EB2 vs. EB3 doesn't even affect I485 processing, let alone EAD renewal. A company's financial position can't have any effect either since an EAD isn't tied to any particular company in any way.

But what about the case with a concurrent 140&485 and 140 is still pending ?

While you apply for an EAD, they would have to make sure that the underlying 140 is not frivolous -- that basically means a quick check on all of the 140 adjudication parameters .... and the ability to pay the proferred wage is definitely one of them

So I wouldn't rule out the link between company financials and EADs just yet - atleast not for all cases.

I'm inclined to think that company financials won't matter much if the 140 is approved though.

Thanks for your replies, I'm sorry for not specifying the complete information. So here it is.

Service Center: NSC
I140: Already approved in 2002.
I485: Still pending, Receipt date: 08/26/2002. I don't know what you mean by ND (for max2K1).
EAD: This is my third renewal. Receipt date is 06/15/2004.

6/15 is not that much of a wait :)

You should probably get the approval within a week to 10 days .... from current times, it looks like its taking about 65-75 days for EAD.
So wait for a bit more ... should be there soon.

btw, ND==notice date -- I just wanted to know RD or ND -- doesn't matter now
