Do canadian PR enter into US directly from India without US visa?
assuming he landed in canada before.

I want to come from India to US directly. I am a Canaian PR and working in US on H1B. I just went to Canada for Landing. Is it OK, and safe to come back on the basis of I-797 and Canada PR Card? Might there be any problems? Otherwise I was thinking of going via canada and coming back via Canada too, to avoid any hassles. Please advise.

That used to be the case earlier and I have done it myself. POst 9/11 too.

However there has recently been enormous speculation even on this board abt when the new rules enforcing US visas for landed immigrants from commonwealth countries would be enforced.

As per the latest rumours it appears that it will be enforced only when such individuals land in the US from outside North America.

Meaning if you are in Canada you can go over without a visa. Of on the other hand you land from outside NA you would have to produce a visa. Do check the US embassy web site

Should I try for getting the H1B stamp in India, will that be safe?
Also, I don't think it would matter if I go to India from Canada and come back to Canada and then into US. I don't think that violates any law. Also, if they ask me at the border, do I need to tell them that I went to India from Canada?

I can only give you my opinion... If it were me I would try for stamping in Canada. The fact that you do notreally live in Canada is a complication I suppose.

You might want to check with your company's attorney's or contact Rajiv Khanna for a paid consultation. I found them very helpful.
