My husband & I married in November 2006. I entered the country on a fiance visa, we filed everything accordingly. Unfortunately, things have not worked out as we had hoped, and the marriage is not working, we are therefore looking at divorce. (My husband has been diagnosed with a gambling addiction, and spent most of our savings). However I’m not sure that this constitutes as a battered/abused wife status?
I have a Green Card, that was issued around the end of February 2007, I believe this is conditional for the first 2 years.
My husband & I rent an apartment in both names, we do have shared bank accounts, we have shared tax forms, etc. Is this enough to prove that we entered the marriage in ‘good faith’?
My question is, is it better for us to separate for 2 years and reconsider a divorce after my Green Card is made unconditional, or could I obtain a waiver to keep my Green Card without too many problems?
Does INS evaluate each case individually, or if there is evidence of enetering the marriage in good faith, do they normally give waivers? If there is a chance that I could get sent back to the UK, we would rather stay separated until 2009, as I have a job here & my parents now live here .
