Divorce issues

I am British with an American wife and daughter. My wife filed for a greencard on my behalf (I was here on a non-immigrant visa). We had our interview in Memphis two months ago and were told that my greencard would be issues as soon as the FBI name check was done. Since then, my wife and I have separated ... I found out that she was spending all our savings and having an affair. I've now filed for divorce and for custody of our 2 year old daughter. My wife doesn't work, sleeps most of the day and has no money. However, since my greencard has not yet been issued, I'm concerned about the action Immigration may take regarding my case. I'm pretty much settled in the US ... I have an excellent job, car payments, I'm buying a house this year, and I provide everything for my daughter. Will they try to deport me and, if so, what are my grounds for appeal?

Are you expecting a condional green card or a unconditional green card?

Get a lawyer.

I'm pretty positive you'll get your green card if you prove that your marriage is bona fide and if you explain them your situation.
