I am on conditional greed card that is about to expire on May 2008. Me and my USC wife both entered the marriage in good faith. Unfortunately however things have been going down hill since I got my conditional green card and our life has become very hard together. Its mostly her fault. She thinks now I am not good enough for her and that I am ruining her life. Even though I have a very good education and job and I make all the money in the house and pay the mortgage and all the bills but this is not enough for her. She is also 5 months pregnant. I don't want to file for divorce but she always asks me to file for it. I told her why don't you go ahead and file for divorce yourself and she says I will once I deliver the baby. She also said even if we remain married I am not going to sign your I-751 and will not help you with any of your immigration papers. She is basically trying to destroy my life. We tried counseling and our families both interfered but to no avail. I know I can petition myself cause I entered the marriage in good faith and I have all the required documents to prove it but I don't want to be the one to file for divorce because I heard its better if the USC spouse files for it. I dont mind staying married until I get the permanent card but like I said she threatened me that she will not sign any papers. I even talked to an immigration lawyer and he told me to go ahead and file for divorce but I would like to get a second opinion from the more knowledgeable people on this forum. I have a few questions that I am looking to find answers to:
1- What happens if we are still married and living together by the time I have to submit the I-751 and she refuses to sign it ?
2- What happens if we get divorced after I submit the joint I-751 and the application is still being processed?
I appreciate all your help in advance, I am really going through a hard time and I wish my marriage would end ASAP but at the same time I care for the baby and I would love to stick around him.
