divorce and custody

My husband and I have been having a lot of trouble for a while now, we got into another argument yesterday and he said he was gonna call a lawyer on monday to get primery custody of our daughter.
He is the USC and I've been out of status for about 4 years.
We were suppose to start filing for my paperworks soon, but now I'm really not sure it will happen.
My question is, will he be granted primery custody because I'm not working and I'm not a legal resident?
can I be deported without my daughter (she has dual citizenship but we never applied for her passport and I'm sure he won't sign the papers to get her one now)?
I'm from France and really wouldn't mind going back there but will never leave my daughter.
What are my options?
Should I just play nice until I get my papers so at least I can have custody and make a living to support us?
I'm not sure wether or not it was an empty threat so I want to be prepared just in case

If you do apply for AOS , it should take you around 6 months to become a LPR ( Depends on your DO ) .

Like Cherr said , you need someone to help you with your marriage , or you need a family lawer .
